House Republicans Refer Hunter, James Biden to DOJ for Prosecution for Allegedly Lying under Oath

House Republicans are sending a criminal referral to the Justice Department accusing Hunter and James Biden of having lied under oath when they testified before lawmakers as part of the impeachment inquiry into President Joe Biden.

Hunter and James Biden should face criminal prosecution for lying to Congress about their respective roles in the Biden family foreign-influence peddling scheme as well as President Biden’s knowledge of and involvement in the business, House Oversight Committee Chairman James Comer (R., Ky.,), Judiciary Committee Chairman Jim Jordan (R., Ohio.), and House Ways and Means Committee Chairman Jason Smith (R., Mo.) argue in the referral.

“Hunter Biden and James Biden made materially false statements to the Oversight Committee and the Judiciary Committee, as demonstrated by the evidence presented in the attached referral. The nature of these false statements is not lost on the Committees: every instance implicates Joe Biden’s knowledge of and role in his family’s influence peddling,”  wrote in the criminal referral obtained by National Review.

In late May, the Ways and Means Committee released new documents from IRS whistleblowers Gary Shapley and Joseph Ziegler that appeared to contradict significant aspects of Hunter Biden’s congressional testimony earlier this year.

The whistleblower documents indicate Hunter Biden held an official role at Rosemont Seneca Bohai, a corporate entity he and business partner Devon Archer set up to receive payments from Ukrainian energy firm Burisma Holdings, bank records show. When he testified, Hunter Biden said he had no knowledge of the Rosemont Seneca Bohai account.

Among the documents are text messages Hunter Biden sent to an executive with the Chinese conglomerate CEFC in July 2017 threatening to have his father use his influence to exact revenge on the business if Hunter did not receive payment as part of a partnership they had set up. Hunter indicated that he was “sitting next to my father” while sending the text, suggesting Joe Biden’s active involvement in the threat. In his testimony, Hunter insisted he was intoxicated when he sent the messages and was not sitting next to his father at the time. He also said the texts were sent to the wrong person in his contact list. Data from Hunter’s cell phone, provided to lawmakers by the IRS whistleblowers, indicates the text was sent to the correct party.

The month after sending the threatening text, Hunter and James Biden opened the Hudson West III joint venture with CEFC, and both made millions from the project, according to bank records and Hunter Biden’s federal tax indictment.

“The nature of these false statements is not lost on the Committees: every instance implicates Joe Biden’s knowledge of and role in his family’s influence peddling. Hunter Biden denying his affiliation with the Rosemont Seneca Bohai Bank Account obfuscates the account to which foreign individuals who met with Joe Biden transmitted funds,” the House Republicans wrote. “Similarly, Hunter Biden creating from whole cloth a fiction in which he transmitted a threat to the wrong individual appears to be an attempt to hide the fact that invoking Joe Biden succeeded in coercing his Chinese partners to send him money.”

Jim Biden is being accused of lying under oath when he testified that he had never attended a meeting with Tony Bobulinski. Jim Biden’s testimony contradicted that of Bobulinski, who vividly recalled during his closed-door testimony in February a meeting he had with Joe Biden, Hunter Biden, Jim Biden, and a Chinese business associate at a Los Angeles hotel in May 2017. Bobulinski repeated his account at a public hearing in March, where he accused Hunter and Jim Biden of lying under oath.

Hunter Biden confirmed he met Bobulinski at the meeting, corroborating the latter’s account. The referral calls Jim Biden’s alleged lie “a clumsy attempt to protect Joe Biden from the reality that Joe Biden has indeed met with his family’s business associates.”

Both Bidens have characterized Bobulinski as a disgruntled former business partner upset about how a joint venture he negotiated with CEFC ended up falling through.

“We’ve caught President Biden’s son and brother making blatant lies to Congress in what appears to be a concerted effort to hide Joe Biden’s involvement in his family’s schemes,” Comer said in a statement provided to NR.

“As part of our efforts to hold the Bidens accountable for profiting off public office, we are today referring Hunter and James Biden to the Justice Department for criminal prosecution for making false statements to Congress. This is not the end of our efforts to hold the Bidens accountable; it’s only the beginning.”

The Biden family’s foreign business dealings are the main subject of the House GOP’s impeachment inquiry. House Republicans have uncovered over $24 million sent from foreign sources to the Biden family and its business associates.

Right now, Hunter Biden is on trial for three federal gun charges related to allegedly lying about his drug addiction on background check paperwork and allegedly possessing a firearm while addicted to drugs. House Republicans are also investigating the Justice Department’s handling of the lengthy criminal investigation into Hunter Biden.

The Justice Department is prosecuting Hunter Biden on the gun charges and federal tax charges for allegedly failing to pay over $1.4 million of taxes across a four year window. It’s unclear if the Justice Department will act on the House GOP’s criminal referrals.

The impeachment inquiry is ongoing.
