Motion to Show Cause Why the 25th Amendment Has Not Been Invoked

Vice President Harris:

Whereas, Section 4 of the 25th Amendment to the Constitution of the United States of America provides that whenever the vice president and a majority of the principal officers of the executive departments declare to the speaker of the House that the president is unable to discharge the powers and duties of his office, the vice president will immediately assume the duties of the office as acting president; and

Whereas, prior to September 20, President Joseph Robinette Biden had not conducted a cabinet meeting since October 2023, despite serious national-security and economic issues affecting the nation, and

Whereas, when President Biden finally convened the first cabinet meeting in nearly a year, he ceded much of the conduct of such meeting to First Lady Jill Biden, who holds no constitutional nor statutory office, has not received a single vote from the American people, and has no authority to preside over official meetings of the office of the president; and

Whereas, there is copious evidence that over the past twelve months President Biden has not been performing even perfunctory elements of the duties of the presidency, and

Whereas, during said period wars have raged involving our allies and/or strategic interests, and

Whereas, several million illegal aliens have entered the United States, many of whom are known terrorists and/or possess serious criminal records; and

Whereas, inflation continues to plague the economy; and

Whereas, there is little evidence that President Biden has been performing more than ceremonial  elements of the duties of the president of the United States; and

Whereas, Minority Leader Pelosi and other elected officials manifestly do not believe President Biden is competent to retain the presidency, let alone discharge the duties thereof, reportedly “forcing” him from the Democratic presidential ticket despite having received 14 million primary votes, 87 percent of the total such votes cast;

Now, therefore, you are hereby requested to show cause why you and a majority of the principal officers of the executive departments of the federal government have not transmitted to the president pro tempore of the Senate and the speaker of the House of Representatives your written declaration that the president is unable to discharge the duties of that office.
