This Day in Liberal Judicial Activism—January 6

2023—Federal district judge Deborah K. Chasanow rules (in Hammons v. University of Maryland Medical System) that a hospital that has a policy of performing hysterectomies on diseased uteruses but not on healthy uteruses discriminates on the basis of sex, as it refuses hysterectomies for the purpose of “gender affirmation” to women who identify as men. Never mind that the policy treats all women—oops, uterus bearers—the same and turns instead on whether or not a uterus is healthy.
