Treating Matt’s post less as a partial dissent than as a friendly amendment on a point that I should have elaborated, I happily accept it.
My core point remains that judicial restraint is not equivalent to judicial abdication and that a faithful practitioner of judicial restraint may well have occasion to determine that a law is unconstitutional.
