Of the five appellate nominees slated for consideration at yesterday’s business meeting of the Senate Judiciary Committee, only one — Third Circuit nominee Kent Jordan — was approved. When it came time to consider Fourth Circuit nominee Terrence Boyle, the committee lacked a quorum. Of note, two Republicans were absent when the vote was called. Jordan and Ninth Circuit nominee Randy Smith are now awaiting consideration by the full Senate. Further committee consideration of Boyle and the other pending appellate nominees (Keisler, Myers, Haynes), will come at the next business meeting.
